When Mediation is the best choice – another way to resolve conflict.
Mediation is a process in which an impartial, neutral and unbiased person, the mediator, facilitates communication and negotiation between parties involved in a conflict. The ultimate goal is to promote understanding, agreement and settlement between the parties to avoid the expense and risk of litigation. Mediation can occur before or after a lawsuit is filed and can result from the agreement of the parties or a court order.
Kyle Sears has completed the 40 hour Basic Mediation Training course at the A.A. White Dispute Resolution Center at the University Of Houston Law Center, Blakely Advocacy Institute in compliance with the Alternative Dispute Resolution Procedures Act. He also serves as a mediator with the Harris County Dispute Resolution Center and the Better Business Bureau.
As a mediator, he is committed to professionalism, preparation, patience and the process of mediation. He will treat the participants with respect and courtesy while doing whatever is necessary prior to the mediation to understand the facts, the law, the issues, the positions and the parties. Kyle will work hard to assist the parties in negotiating a settlement, including continuing to work after the conclusion of a mediation session which does not result in a settlement. He will be patient with the participants and allow the process to work without pressure and posturing or wasting the time of the participants by prolonging a mediation that has reached an impasse or has otherwise become unproductive.
Kyle has the flexibility to mediate at his office, 808 Travis Street, Suite 1100, Houston, Texas 77002, or at another location acceptable to the participants.
